Subject: Update on the NCLB's Requirements for Teachers and Paraprofessionals

On December 19, 2002, the U.S. Department of Education (USDOE) issued non-regulatory draft guidance related to Title II, Part A of the No Child Left Behind Act of 2001 (NCLB).  This guidance is intended to provide assistance to state education agencies and local education agencies that are implementing the NCLB and does not have the force of law. You can find it on the USDOE’s Web site if you click on “Policy and Legislation” at: www.nclb.gov.

We will provide additional information about implementing the NCLB’s requirements as further guidance and final regulations become available.  Until then, please be guided by NCLB NYS Field Memo #01-2002 (available on the New York State Education Department’s Web site at: www.highered.nysed.gov) and subsequent field memos notifying you about final regulations and other guidance issued by the USDOE.

Please continue to send your questions about the NCLB to nclbnys@mail.nysed.gov.
